1. Scope

These General Terms and Conditions ("GTC") apply to all contracts concluded between the seller and the customer, in particular via the online shop at www.ju-li-kunst.at .
They regulate the rights and obligations of the contracting parties and the withdrawal rights for consumers in accordance with point 8.
For business transactions, the provisions in Section II also apply.


2. Acceptance of the General Terms and Conditions

By placing an order, the customer agrees to these Terms and Conditions. Deviating agreements are only valid if confirmed in writing.


3. Conclusion of contract

3.1. Offer
The product presentation in the online shop does not constitute a legally binding offer, but rather an invitation to the customer to submit an offer.
Note: Minor color variations of the products due to technical conditions are possible and do not constitute a defect.

3.2. Conclusion of the contract
The contract is only concluded when Julia Lippitsch expressly accepts the order, for example by written confirmation via email or by delivery of the goods.

3.3. Geographical restriction
The online shop is aimed exclusively at customers with delivery addresses in Austria, Germany, Italy or Switzerland.


4. Website access and terms of use

4.1 Minimum age and legal capacity
Customers must be at least 18 years old and of full legal capacity.

4.2. Availability of the website
There is no guarantee that the website will be available at all times. Maintenance work or technical malfunctions may affect access.


5. Prices, delivery and shipping costs

5.1. Prices
All prices include statutory VAT. Shipping costs are not included and will be shown during the ordering process.

5.2. Pricing errors
Subject to price changes and errors. The customer will be contacted if the price is higher; a contract is only concluded if the customer agrees to the higher price.


6. Terms of payment

The purchase price is due without deductions before delivery of the goods. Accepted payment methods:

  • Online shop: Advance invoice
  • Store purchase: Cash payment

Note: The amount will be collected upon acceptance of the offer by the seller.


7. Delivery

7.1. Delivery times
The delivery time is approximately 14 working days after acceptance of the order, provided the goods are available.

7.2 Force majeure
Delivery delays due to force majeure or unforeseeable events (e.g. transport delays) will extend the delivery time accordingly.

7.3. Delivery address
The customer is obligated to provide a correct delivery address. Incorrect addresses and any resulting additional costs are the customer's responsibility.


8. Right of revocation and withdrawal

According to Section 18 Paragraph 1 Item 3 FAGG, a right of withdrawal is excluded, as the art prints are individually produced according to customer specifications.

9. Retention of title

The goods remain the property of Julia Lippitsch until full payment has been made.


10. Warranty

10.1. Consumers
The statutory warranty rights apply (Section 8 KSchG).

10.2. Entrepreneurs
For entrepreneurs, the warranty rules in Section II apply.


11. Liability

We are only liable for damages caused intentionally or by gross negligence. This limitation of liability does not apply to personal injury or claims under the Product Liability Act.


12. Data protection

Your personal data will be used exclusively to process your order. For details, see our privacy policy at [link].


13. Place of jurisdiction and choice of law

The place of jurisdiction for all disputes is Innsbruck, unless mandatory legal provisions conflict.


14. Changes to the Terms and Conditions

Changes to the Terms and Conditions will be communicated to the customer in a timely manner. They will be deemed accepted if the customer does not object within six weeks.


15. Severability Clause

Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.


SECTION II – BUSINESS TRANSACTIONS

The following additional deviating provisions apply to contracts with entrepreneurs:

II.1. Warranty and notification of defects
Entrepreneurs must report defects in writing within 4 working days of receipt of the goods.

II.2. Liability
Liability is limited to intent or gross negligence.
